Terms of Service

By placing an order with American Rock Supply ("we," "us," or "our"), you agree to the following terms and conditions. Please read them carefully before completing your purchase.

Ordering and Custom Requests

When placing your order, please select a delivery date that is at least two (2) business days from the date of purchase. If you have specific instructions or requests regarding placement, access, or materials, include them during checkout. A valid phone number is required to confirm delivery. Orders submitted without a valid contact number may be delayed or rescheduled. While we aim to deliver on your selected date, factors such as road conditions, weather, supplier availability, or truck scheduling may cause occasional delays.

Order Confirmation

You will receive an email confirmation detailing your order, payment, and delivery specifics upon successfully submitting your order. Please review this confirmation thoroughly to ensure all information is accurate. By placing the order, you agree to be available or have a designated contact at the delivery site during the delivery window.

Pricing

All prices are listed per ton (or per yard for applicable products) and are subject to change without notice. The price confirmed at the time of order submission is the price you will be charged. Prices include delivery. Applicable taxes are calculated at checkout based on delivery location.

Delivery Site Requirements

Customers are responsible for ensuring the delivery site is accessible to our trucks. A minimum road width of 12 feet is required to accommodate delivery vehicles. If access is restricted, unsafe, or otherwise impractical, our team will attempt to deliver materials as close as possible to your requested location without compromising safety. A missed delivery fee may apply if the delivery cannot be completed due to access restrictions, site conditions, or customer absence.

Delivery Acceptance and Transfer of Responsibility

The customer or an authorized representative must be present to receive the delivery within the specified time frame. Upon unloading of materials, ownership and responsibility for the products pass entirely to the customer. Once unloaded, the customer assumes full ownership and accountability for the materials. No refunds or exchanges will be provided after materials have been unloaded, except as required by applicable law. We bear no responsibility for any damage to the materials or property following delivery.

If the customer is not on site at the time of delivery, American Rock Supply may, at its sole discretion, unload the material at the nearest accessible location. By not being present at the time of delivery, the customer acknowledges and accepts full responsibility for the material once it is placed, including any handling or relocation that may be required.

Material Availability and Natural Variation

American Rock Supply coordinates with a network of regional suppliers across the country. Product photos on our site are representative and provide a general visual reference for the type of material ordered. Aggregate materials are natural products, and their color, shade, texture, and sizing may vary depending on local availability, seasonality, and regional geology. While we make every effort to match the product to the photos and your preferences, exact matches cannot be guaranteed due to natural variation and geographic sourcing differences. By placing an order, you acknowledge and accept these terms.

Missed Delivery and Re-Delivery Fees

If delivery cannot be completed due to site inaccessibility, customer absence, or refusal to accept the material, we reserve the right to charge a missed delivery fee. In such cases, we will reschedule delivery as soon as possible, subject to additional re-delivery charges.

No Spreading or Installation Services

All aggregate materials are sold as-is. American Rock Supply does not provide spreading, grading, or installation services, and such services are not included in the cost of materials. In some cases, the delivery driver may offer a courtesy "rolling dump" (lowering the tailgate and slowly driving forward to distribute the material). However, this is entirely at the discretion of the driver at the time of delivery and cannot be guaranteed or requested in advance.

Property Damage Disclaimer

Our haulers exercise care during delivery, but American Rock Supply will not be held responsible for any damage to driveways, lawns, structures, utilities, or landscaping caused by delivery vehicles. It is the customer's responsibility to confirm that the delivery site and surrounding property can accommodate heavy commercial trucks and the weight of bulk aggregate materials.

Force Majeure

We are committed to providing timely delivery services; however, we are not responsible for delays or failures caused by events beyond our reasonable control, including but not limited to adverse weather, road closures, natural disasters, equipment failures, supplier shortages, labor disputes, government actions, or pandemics. In such instances, we reserve the right to reschedule delivery without liability.

Payment Processing

American Rock Supply uses Stripe for credit card transactions. In rare cases, additional verification may be needed to ensure payment security. If necessary, we will notify you by email or phone to gather the required information. Orders may be held or cancelled if payment verification cannot be completed.

Limitation of Liability

To the maximum extent permitted by applicable law, American Rock Supply's total liability for any claim arising from or related to your order shall not exceed the total amount paid by you for that specific order. In no event shall American Rock Supply be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or other intangible losses.

Indemnification

You agree to indemnify, defend, and hold harmless American Rock Supply, its officers, directors, employees, agents, and suppliers from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney's fees) arising out of or in connection with your use of our services, your violation of these terms, or your violation of any rights of a third party.

Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes arising under these terms shall be resolved in the state or federal courts located in Delaware.

Changes to These Terms

We reserve the right to modify or update these Terms of Service at any time. Any changes will be posted on this page with a revised date. Continued use of the Website after changes are posted constitutes acceptance of the updated terms. We encourage you to review this page before placing an order.
